What happens if you buy a TDI right now?

If a person were to purchase a TDI right now, would you still be eligible for a payout? What about buyback?

As I read the documents it seems to say “yes” you are eligible for a payout but the amount will be reduced but it’s not clear what the calculation is.

There are 2009 TDI wagons listed for under buyback amount. Could a person just buy a wagon, drive it to the local vw dealer and ask for a buyback and pocket the difference?

Because this is aimed at curbing emissions and not just making owners whole, it seems like you should be eligible for some sort of payment when the fix is made but it seems wrong that you’d be able to get a car purchased now bought back.

I’d say that’s a dickish move

No. You have to have owned or leased the car before hand.

Per the rules, you must have been “the registered owner or lessee of an Affected Vehicle as of November 8, 2015 ”

Lol. Yeah, but I wonder how many people are going to try it, only to be lumbered with the car and then try and take it out on the seller and VW.

That's the goodwill program, not the class action settlement.

Check the docs from the settlement, I edited to add them. It seems to state that if you buy after June 28 you become eligible.

I’m not so sure, I edited my post to add the settlement docs.

And also, there are like 223 other pages of settlement docs, so, maybe something I haven’t seen addresses this...

hm. Well it's worth a shot. But I wouldn't buy one unless you actually wanted one, lest you be stuck with it for some reason they haven't yet devised. It might be a dickish move, but so was cheating the emissions testing. Turnabout is fair play and all.

Yeah, it's risky because there's always the chance that there will be no acceptable fix and then states won't allow registration for non complying cars.

I’ve bought three more since the settlement was announced. Planning on nearly doubling my money. I've got some family members buying, too.

Look, if VW is going to pay you to go out and find TDIs and bring them back in, how is that a dick move?

For the record, I bought my three extra TDIs from dealers, not owners. They either made a decision to clear the space on the lot or weren’t keeping up with the industry. Either way, I sleep well at night.

It’s gonna be a sweet pile of cash come October.

I didn’t think VW was allowed to sell any cars that fell under the scandal

VW can't but used car dealers can.

Yep, you are correct. For the buyback program, it looks like the post-9/18/15 buyers get to sell the car back plus get a proportional share of the Owner Restitution. And then potentially a kicker if there are unused funds (disclaimer: I didn’t read this stuff that carefully, as you already discovered from my first post!).

I’m almost a little surprised that I see them for sale at smaller dealerships. I would think they would just want to throw a tarp over the thing and wait it out. I actually kind of want a sportwagen, but may hold out until after a fix is known, but while I could still get a payout. I’m hoping that fix plus upgraded turbo and ecu flash, and I still can have a sporty fun people hauler that doesn’t obliterate the environment and is fairly cheap.

Here’s my perspective there. You buy it, you drive it, you jump it, whatever. In October, if things go well today, they’re guaranteed to buy it back from you. For more than you paid!

It’s an opportunity to take a long term test drive and make money at the same time. Fix, schmix, I say. Buy a few cars, drive them around, make three monthly payments, then cash out.

And remember, you can buy, drive until they announce a fix (deadline for that is 2018) and then decide to fix or sell back. If you really like whatever you buy, you can keep it two years, then get your money back. Or just keep it, but that would be nuts, since they’ll pay you more than it’s worth.

It’s a win, win, or win.
